Attempts to circumvent these requirements are generally prohibited. Under the INA, an alien who uses, acquires, or produces fraudulent documents for immigration-related purposes may be subjected to civil penalties and denied certain immigration benefits. Additionally, certain fraudulent actions may carry criminal penalties under both the INA and the United States Criminal Code. This report discusses the primary civil, criminal, and immigration-related penalties associated with immigration-related document fraud. It does not discuss criminal statutes generally penalizing fraud or identity theft (other than 18 U.S.C. \u00a7 1028), though these statutes could also potentially be used to penalize immigration-related document fraud.\nImmigration reform was an active issue during the 110th Congress. Some legislative proposals contained provisions modifying the scope or penalties of laws restricting immigration-related document fraud, and it is possible that proposals addressing immigration-related document fraud will be introduced in the 111\tth Congress. \nFor a more general discussion of immigration-related fraud, see CRS Report RL34007, Immigration Fraud: Policies, Investigations, and Issues, by Ruth Ellen Wasem.", "type": "CRS Report", "typeId": "REPORTS", "active": false, "formats": [ { "format": "HTML", "encoding": "utf-8", "url": "http://www.crs.gov/Reports/RL32657", "sha1": "d5dc7909b9103b4d1d88b0aaeb49840a54eb0d5a", "filename": "files/20090123_RL32657_d5dc7909b9103b4d1d88b0aaeb49840a54eb0d5a.html", "images": null }, { "format": "PDF", "encoding": null, "url": "http://www.crs.gov/Reports/pdf/RL32657", "sha1": "76fae62bf6a7be75945b13811b9ea280fb003bcd", "filename": "files/20090123_RL32657_76fae62bf6a7be75945b13811b9ea280fb003bcd.pdf", "images": null } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metadc810838/", "id": "RL32657_2008Jan10", "date": "2008-01-10", "retrieved": "2016-03-19T13:57:26", "title": "Immigration-Related Document Fraud: Overview of Civil, Criminal, and Immigration Consequences", "summary": null, "type": "CRS Report", "typeId": "REPORT", "active": false, "formats": [ { "format": "PDF", "filename": "files/20080110_RL32657_c711f36f3e6d5dde2330d43eea08c80ca4595ba1.pdf" }, { "format": "HTML", "filename": "files/20080110_RL32657_c711f36f3e6d5dde2330d43eea08c80ca4595ba1.html" } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metadc813582/", "id": "RL32657_2006Dec18", "date": "2006-12-18", "retrieved": "2016-03-19T13:57:26", "title": "Immigration-Related Document Fraud: Overview of Civil, Criminal, and Immigration Consequences", "summary": null, "type": "CRS Report", "typeId": "REPORT", "active": false, "formats": [ { "format": "PDF", "filename": "files/20061218_RL32657_28a2c857a77322f50b156a9815d5a5b94a8ca34b.pdf" }, { "format": "HTML", "filename": "files/20061218_RL32657_28a2c857a77322f50b156a9815d5a5b94a8ca34b.html" } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metadc814919/", "id": "RL32657_2006Sep05", "date": "2006-09-05", "retrieved": "2016-03-19T13:57:26", "title": "Immigration-Related Document Fraud: Overview of Civil, Criminal, and Immigration Consequences", "summary": null, "type": "CRS Report", "typeId": "REPORT", "active": false, "formats": [ { "format": "PDF", "filename": "files/20060905_RL32657_add2f66d609481d7ee490f9447256b88d442542a.pdf" }, { "format": "HTML", "filename": "files/20060905_RL32657_add2f66d609481d7ee490f9447256b88d442542a.html" } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metadc817740/", "id": "RL32657_2005Dec07", "date": "2005-12-07", "retrieved": "2016-03-19T13:57:26", "title": "PROVIDED BY ILW The leading immigration COM law publisher Immigration-Related Document Fraud: Overview of Civil, Criminal, and Immigration Consequences", "summary": null, "type": "CRS Report", "typeId": "REPORT", "active": false, "formats": [ { "format": "PDF", "filename": "files/20051207_RL32657_4aec63a5064c6d89e40a69abe41e2c59fc247161.pdf" }, { "format": "HTML", "filename": "files/20051207_RL32657_4aec63a5064c6d89e40a69abe41e2c59fc247161.html" } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metadc808631/", "id": "RL32657_2004Dec21", "date": "2004-12-21", "retrieved": "2016-03-19T13:57:26", "title": "Immigration-Related Document Fraud: Overview of Civil, Criminal, and Immigration Consequences", "summary": null, "type": "CRS Report", "typeId": "REPORT", "active": false, "formats": [ { "format": "PDF", "filename": "files/20041221_RL32657_480ac06bc8ae1de7f66907ac8ec3724ab40fd7f8.pdf" }, { "format": "HTML", "filename": "files/20041221_RL32657_480ac06bc8ae1de7f66907ac8ec3724ab40fd7f8.html" } ], "topics": [] } ], "topics": [ "Intelligence and National Security" ] }
