These actions would, if\nimplemented, substantially reduce air pollutants, particularly nitrogen oxides (NOx). These\ninitiatives include the Ozone Transport Rule (also called the NOx SIP Call); a set of \"Section 126\npetitions\" in which 12 states allege under Section 126 of the Clean Air Act (CAA) that pollutants\noriginating in upwind states prevent their attainment of clean air standards; and a set of enforcement\nactions based on New Source Review (NSR) requirements of the CAA that have resulted in lawsuits\nagainst several utilities and an administrative order against the Tennessee Valley Authority (TVA). \nAlthough these are separate initiatives, they are related in that each ultimately focuses on emissions\nfrom utilities in the Midwest and South. As of January 22, 2001, the EPA has declared 11 states and\nthe District of Columbia as failing to submit revised SIPs required under the Ozone Transport Rule;\nthe EPA has approved four section 126 petitions; and two of the NSR lawsuits have resulted in\nconsent decrees (Tampa Electric Co. and PSEG), and two others have been settled in principle\n(Virginia Power and Cinergy). In June 2002, the Bush Administration recommended new\nrulemaking be commenced on the definition of \"routine maintenance\": a key point of contention in\nthe lawsuits. Legislative activity focuses on multi-pollutant strategies as an alternative to these\npiecemeal initiatives. In June 2002, the Senate Environment and Public Works Committee reported\nout S. 556 -- a comprehensive, multi-pollutant reduction bill. This report will be\nupdated as events warrant.", "type": "CRS Report", "typeId": "REPORTS", "active": false, "formats": [ { "format": "HTML", "encoding": "utf-8", "url": "http://www.crs.gov/Reports/RS20553", "sha1": "3af653aec80e56c0e1dc7e5a2f6e6eaaacda4cd1", "filename": "files/20021025_RS20553_3af653aec80e56c0e1dc7e5a2f6e6eaaacda4cd1.html", "images": null }, { "format": "PDF", "encoding": null, "url": "http://www.crs.gov/Reports/pdf/RS20553", "sha1": "20095e234f894170712b963b38cf1cd32cf25b2a", "filename": "files/20021025_RS20553_20095e234f894170712b963b38cf1cd32cf25b2a.pdf", "images": null } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metacrs2141/", "id": "RS20553 2002-03-19", "date": "2002-03-19", "retrieved": "2005-06-10T18:39:41", "title": "Air Quality and Electricity: Initiatives to Increase Pollution Controls", "summary": "This report discusses air quality initiatives (such as the Ozone Transport Rule) that primarily focus on reducing and enforcing emissions from coal-fired electric generating utilities in the Midwest and South.
