The visa most of these physicians enter under is the J-1 nonimmigrant visa. Under the J-1 visa program, participants must return to their home country after completing their education or training for a period of at least two years before they can apply for another nonimmigrant visa or legal permanent resident (LPR) status, unless they are granted a waiver of the requirement.\nTo qualify for a waiver, a request must be submitted on behalf of the FMG, by an Interested Government Agency (IGA), or a state Department of Health. In exchange, the FMG must agree to work in a designated healthcare professional shortage area for a minimum of three years. The ability of states to request a waiver is known as the \u201cConrad State Program,\u201d and was added temporarily to the Immigration and Nationality Act (INA) in 1994. The \u201cConrad State Program\u201d has been extended by the past several Congresses. Most recently, the program was extended until September 30, 2009, by P.L. 111-9. This report will be updated as warranted by legislative developments.", "type": "CRS Report", "typeId": "REPORTS", "active": false, "formats": [ { "format": "HTML", "encoding": "utf-8", "url": "http://www.crs.gov/Reports/RS22584", "sha1": "2d2df569e0f6cf7bad75cb0c8136c55506e339f5", "filename": "files/20090819_RS22584_2d2df569e0f6cf7bad75cb0c8136c55506e339f5.html", "images": null }, { "format": "PDF", "encoding": null, "url": "http://www.crs.gov/Reports/pdf/RS22584", "sha1": "4b7093af7a0d7796abccea6db61c906a663d49b8", "filename": "files/20090819_RS22584_4b7093af7a0d7796abccea6db61c906a663d49b8.pdf", "images": null } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metadc808062/", "id": "RS22584_2008Oct01", "date": "2008-10-01", "retrieved": "2016-03-19T13:57:26", "title": "Foreign Medical Graduates: A Brief Overview of the J-1 Visa Waiver Program", "summary": null, "type": "CRS Report", "typeId": "REPORT", "active": false, "formats": [ { "format": "PDF", "filename": "files/20081001_RS22584_840cb03d8172ced21945b2fec3288d7a5672d0c9.pdf" }, { "format": "HTML", "filename": "files/20081001_RS22584_840cb03d8172ced21945b2fec3288d7a5672d0c9.html" } ], "topics": [] }, { "source": "University of North Texas Libraries Government Documents Department", "sourceLink": "https://digital.library.unt.edu/ark:/67531/metacrs10688/", "id": "RS22584_2008Jun05", "date": "2008-06-05", "retrieved": "2008-12-11T20:32:01", "title": "Foreign Medical Graduates: A Brief Overview of the J-1 Visa Waiver Program", "summary": "The Educational and Cultural Exchange Visitor program has become a gateway for foreign medical graduates (FMGs) to gain admission to the United States as nonimmigrants for the purpose of graduate medical education and training.
